TWO MET POLICE ESCAPE SEXUAL ASSAULT CHARGE WITH SLAP ON THE WRISTS

Notice for Gross Misconduct Hearing held in public on 28 June – 2 July 2021 at 0930hrs.

It is alleged that PC Weatherley has breached the standards of professional behaviour in relation to Duties and Responsibilities, Orders and Instructions, Authority, Respect and Courtesy, Equality and Diversity and Honesty and Integrity.

It is alleged that PC Weatherley did not record a stop and search on her BWV as required to do so.  PC Weatherley did not fully consider the account provided by a victim of a serious crime and/or the victims needs and as a result did not offer a private place for the account to be given.  Furthermore, PC Weatherley misrepresented or was dishonest when disclosing the information provided by a witness when updating colleagues about the alleged crime and the victim’s needs.  As a result PC Weatherley entered a potential crime scene and did not record this on BWV and allowed the victim to access the scene.  PC Weatherley did not complete a crime report or seek advice regarding the crime that was alleged.  When the crime was reported to other officers PC Weatherley completed a statement but did not include any detail regarding the allegations made about the serious crime which was misleading or dishonest.   PC Weatherley did not make any reasonable adjustments or consider the needs of the victim who is autistic.

It is alleged that these matters amount to Gross Misconduct, which is so serious that dismissal is justified.

It is alleged that PC Quinney has breached the standards of professional behaviour in relation to Duties and Responsibilities, Orders and Instructions, Authority, Respect and Courtesy, Equality and Diversity and Honesty and Integrity.

It is alleged that PC Quinney did not record a stop and search on his BWV as required to do so.  PC Quinney did not fully consider the account provided by a victim of a serious crime and/or the victims needs and as a result did not offer a private place for the account to be given.  When informed by PC Weatherley about the victim’s needs PC Quinney did not reconsider what he had been told by the victim.  PC Quinney entered a potential crime scene and did not record this on BWV and allowed the victim to access the scene.  PC Quinney did not complete a crime report or seek advice regarding the crime that was alleged.  When the crime was reported to other officers PC Quinney completed a statement but did not include any detail regarding the allegations made about the serious crime which was misleading or dishonest.   PC Quinney did not make any reasonable adjustments or consider the needs of the victim who is autistic.

The panel considered all of the evidence and found the following:

PC Amy Weatherley was found to have breached the standards of professional behaviour in relation to Duties and Responsibilities, Orders and Instructions, Authority, Respect and Courtesy, Equality and Diversity at the level of Gross Misconduct.  She was not found to have breached the standard of Honesty and Integrity.  PC Weatherley was issued a Final Written Warning.

PC Paul Quinney was found to have breached the standards of professional behaviour in relation to Duties and Responsibilities, Orders and Instructions, Authority, Respect and Courtesy, Equality and Diversity at the level of Gross Misconduct.  He was not found to have breached the standard of Honesty and Integrity.  PC Quinney was issued a Final Written Warning.
